Terms & Conditions

1. Scope

These Terms & Conditions govern every agreement between Arty Trades (the "Provider") and customers for the purchase or use of software licenses, recurring subscriptions, and trading mentorship memberships. By placing an order, you confirm that you are at least 18 years old and legally authorized to enter into binding contracts.

2. Subject of the Agreement

• Perpetual license: one-time purchase that grants a non-transferable, non-exclusive right to install and use the software on the agreed number of devices.
• Subscription: time-limited access (monthly or yearly) that includes software updates, feature enhancements, and support during the active term.
• Mentoring membership: access to coaching calls, community features, templates, and other materials described in the respective plan.

3. License and Usage Rights

You may use the delivered software solely for your own trading workflow. Reverse engineering, resale, sharing of activation keys, or any modification beyond what is allowed by law is prohibited. Updates are part of active subscriptions. Perpetual licenses receive updates only if explicitly stated in the offer.

4. Subscriptions

1. Subscriptions automatically renew for the same term unless they are cancelled at least 14 days before the billing date.
2. Cancellation can be issued through the customer portal or in writing to the contact listed in the legal notice.
3. Once a subscription renews, the new term becomes fully due. Partial refunds for unused time are not provided.

5. Pricing and Payment

Prices displayed during checkout apply. Unless noted otherwise, prices are shown in U.S. dollars and exclude any taxes that may apply in your jurisdiction. Payment is due immediately upon order. Supported methods (such as credit card or PayPal) are shown during checkout.

6. Digital Delivery and Withdrawal

All products are delivered digitally. Because fulfillment starts immediately, your statutory right of withdrawal expires once you access the download, activation key, or mentoring materials. If you prefer to keep your withdrawal right, do not start the download or onboarding after purchase.

7. Warranty and Liability

The software is provided "as is" with the functionality described in the documentation. We warrant that the delivered files are free from malware and can be installed on supported systems. Liability for indirect losses, lost profits, or trading losses is excluded. Nothing in these terms limits liability for gross negligence, willful misconduct, or injury to life, body, or health.

8. Privacy

Personal data is processed according to our Privacy Policy. We use the information you provide to set up licenses, fulfill orders, and comply with legal obligations.

9. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law rules. Mandatory consumer protections granted by your country of residence remain unaffected.

10. Venue

The courts of Berlin, Germany, have exclusive jurisdiction for disputes with merchants and public-law entities. Consumers may bring claims before the competent court of their domicile.

11. Final Provisions

If any clause of these Terms becomes invalid, the remaining provisions stay in full force. We may update these Terms to reflect product, legal, or pricing changes. Material updates will be announced via email or within the member area.
